Terms of Use
These are the terms for using fathommedicine.com. We've kept them short — a legal page is still a legal page, but it doesn't need to be a wall of capitalized nouns.
"Fathom" means Fathom Medicine, PLLC; "the Site" means this website. The Terms below cover the Site only. If you join Fathom as a patient, the relationship is governed by a separate Membership Agreement you sign when you enroll — that document, not this page, defines the care relationship.
1. The Site Is Informational, Not Clinical
The Site describes Fathom's practice — how the model works, what's included, how to get in touch. Nothing on the Site is medical advice, a diagnosis, or a treatment recommendation. Reading the Site does not make you a Fathom patient, and using the Site does not create a physician-patient relationship.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency department. Do not use the Site, the contact form, or email to communicate about an emergency.
If you are an established Fathom patient, clinical communication happens through the patient portal, by phone, or through the other channels your physician has designated — not through the Site's public contact form.
2. Membership Terms Are Separate
If you join Fathom, the terms of your care — fees, scope, cancellation, after-hours expectations, hospital coordination, and the rest — are governed by a signed Membership Agreement between you and Fathom Medicine, PLLC. That agreement, not these Terms, controls the patient relationship.
Pricing, scope-of-care, and operational descriptions on the Site are summaries provided for prospective patients. They are not contractual terms and may be updated over time.
3. Acceptable Use
You're welcome to read, share, and link to the Site for any lawful purpose. You may not:
- Use the Site to harass, defame, or harm anyone
- Attempt to gain unauthorized access to the Site, its underlying systems, or the accounts of others
- Scrape the Site at volumes that interfere with normal use, or use automated systems to submit forms
- Misrepresent your identity in communications with us
- Use the Site, or content from it, in a way that violates applicable law
4. Intellectual Property
The Site's design, text, photographs, logo, and written content are owned by Fathom Medicine, PLLC, except where another source is credited. You're welcome to share links and brief quotations with attribution. Republishing substantial portions, training machine-learning systems on the content, or using Fathom's name or marks in a way that implies endorsement requires written permission.
5. Third-Party Links
The Site may link to outside resources — clinical references, articles, the EMR vendor's patient portal, regulatory sites. We don't control those resources and aren't responsible for their content, accuracy, or practices. Following a link off the Site means you've left it.
6. Limitation of Liability
To the fullest extent permitted by law, Fathom Medicine, PLLC and its physicians, employees, and agents will not be liable for indirect, incidental, consequential, special, or punitive damages arising out of your use of the Site — including loss of data, loss of profits, or business interruption — even if we have been advised of the possibility of such damages.
Nothing in this section limits liability for the practice of medicine, professional negligence, or any liability that cannot be limited or excluded under applicable law.
7. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Kitsap County, Washington, and you consent to the personal jurisdiction of those courts.
